Earlier this year, legislation SB 2487 was introduced to the state of Hawaii. If this legislation were to pass, it would reduce the penalties for marijuana possession within the state. Currently, Hawaii has relatively harsh laws concerning marijuana. The possession of more than three grams of cannabis is defined by the state’s law as a criminal misdemeanor. It is therefore punishable by up to 30 days in jail and a $1,000 fine.

Had SP 2487 been passed, these penalties would have been reduced to a $25 civil fine. However, senate members voted 15 to 9 to defeat SB 2487 last month. Just weeks before this decision, the senators had voted 24 to 1 in favor of the bill. Even one week prior, they had agreed to changes to the legislation which had been proposed by the House. So why did they ultimately vote to reject this legislation?

Opponents of this measure were concerned that it would “send the wrong message to young people,” and interfere with the tourism industry. Nikos Leverenz, board president for the Drug Policy Forum of Hawaii, says that these opponents “want to ensure broad prohibition.” Unfortunately, as long as this is the case, there will be relatively harsh consequences for marijuana possession in the state of Hawaii.

Is CBD Legal in Hawaii?

When the Farm Bill was passed in 2018, CBD products were federally legalized in the United States. According to this legislation, hemp products may legally contain up to 0.3% delta-9 THC (the psychoactive cannabinoid found in marijuana). However, individual states can implement their own laws and restrictions concerning hemp products. Therefore, although CBD products which contain 0.3% or less THC are legal on the federal level in the United States, they are not legal for everyone in the state of Hawaii. In fact, it is illegal to purchase or possess hemp products which contain any trace of THC within the state of Hawaii unless you have a medical marijuana card.
