Delta-9 THC is the primary concern when purchasing legal hemp extracts. If hemp companies don’t meet the federally-recognized legal THC levels, they could go out of business.

Therefore, it might be surprising to hear that a few vendors are openly advertising “high delta-9” on their hemp gummies. Even more surprising, dozens of shops sell these “hemp delta-9 edibles” to customers in states with restrictive cannabis laws.

At this point, you’re probably confused over why companies would sell products that are obviously illegal. Or, does this mean hemp-derived delta-9 THC is legal in the USA? Is it safe to buy delta-9 gummies from reputable hemp stores?

How Could Vendors Sell Hemp Delta-9 Gummies In The USA?

Today’s hemp-derived delta-9 THC gummies take advantage of a very sneaky loophole in the 2018 US Farm Bill. As CBD fans may already know, this law legalized hemp-derived products with ≤ 0.3 percent delta-9 THC on a dry weight basis. Technically, it’s OK for hemp products to have a tiny bit of delta-9 THC.

To abide by this statute and offer higher THC percentages, some hemp shops have begun maxing out their delta-9 levels. Since gummies weigh more than most hemp products, it’s easier to push the delta-9 percentage to a level where customers will experience a “light buzz.” For instance, some companies manufacture packets of five gummies that weigh 20 grams, and each gummy has 10 mg of delta-9 THC.

As long as the delta-9 concentration falls within the 0.3 percent limit, it fits the 2018 US Farm Bill’s current wording. Yes, this is a questionable technicality, but some brands feel it’s worth the risk to offer potentially lucrative delta-9 products.

Even after manufacturers explain how hemp-derived delta-9 gummies are “legal,” most customers can’t believe they’re legit—and rightfully so! While hemp delta-9 THC gummies tick all the boxes in the 2018 US Farm Bill, they will face increased legal scrutiny at the local level. Many states have already put restrictions on delta-8 THC, so there’s no reason to believe they wouldn’t target these delta-9 gummies.

Delta-9 gummies are technically legal if they have ≤ 0.3 percent delta-9 and come from hemp plants. However, delta-9 THC remains a Schedule I drug at the federal level. Since both of these laws are somewhat contradictory, it’s hard to say whether delta-9 edibles are “safe” to buy in the USA.

The only customers who could feel confident about trying hemp delta-9 THC edibles are those who live in states with relaxed recreational weed laws. Otherwise, customers should be hesitant about ordering hemp-derived delta-9 goods at this time.

Research Delta-8 THC Gummies For A Safer “High”

Most people who try delta-8 THC claim it’s not as intense as delta-9 THC. Plus, there’s less risk of legal repercussions surrounding hemp delta-8 in the USA. Although a few states have restrictive delta-8 laws, it’s easier for most Americans to find legal & lab-tested hemp delta-8 products
