A new bill being drafted could place limitations and age restrictions on delta-8 products in Ohio. State senator Steve Huffman says that his goal is to keep delta-8 out of the hands of kids while keeping CBD shops in business. Through this bill, Huffman is hoping to establish a new age restriction on delta-8, only allowing it to be sold to customers who are 21 and older.
What is Delta-8?
Delta-8 is a minor cannabinoid found in both hemp and cannabis plants. In reality, there still hasn’t been an abundance of research about major cannabinoids such as CBD and delta-9 THC, and there is even less about minor cannabinoids like delta-8 THC. However, there are some things we know about this increasingly popular cannabinoid.
Delta-8 THC appears in all cannabis and hemp plants in very small concentrations. Because it is only naturally available in such small amounts, many delta-8 products are made with delta-8 that has been produced from a lab. Scientists are able to convert CBD to delta-8 THC through a complicated chemical process. Because most delta-8 products contain delta-8 that has been produced this way, it is important to check a product’s COA, or Certificate of Analysis, before making a purchase. A COA will show you the third party lab test results for its product, so that you can verify the cannabinoid levels claimed on the label, as well as rest assured that the product contains no harmful solvents or pesticides.
Most delta-8 THC users report similar, yet somewhat milder effects as those produced by delta-9 THC, the cannabinoid associated with the traditional marijuana “high.” In other words, delta-8 THC could be perfect for those who are looking for some psychoactive effects, which don’t come with CBD use, but who also don’t want the more intense effects of delta-9.
Is Delta-8 Legal?
Because the delta-8 found in most products comes from hemp plants, these products are subject to the restrictions set forth in the 2018 Farm Bill. Like CBD products, delta-8 products may legally contain up to 0.3% delta-9 THC. As long as a delta-8 product meets these guidelines, it is federally legal. However, individual states do have the power to set their own restrictions on delta-8 products, or to even ban them altogether.
Arizona, Delaware, and Idaho are just three of a dozen states that have banned delta-8 THC because it is a psychoactive cannabinoid. Senator Huffman has been clear that he is not working for Ohio to join this list. Instead, he wants to place restrictions on delta-8 products so that children and people under the age of 21 cannot so easily obtain them. Huffman is adamant about keeping CBD products on store shelves, as they are not intoxicating.
