FAQ

What is Delta 8?

Delta 8 is a type of cannabis product that exists in the space between marijuana and CBD. While it has similarities to both, it is its own product.
The product is a derivative of hemp. Delta 8 itself is what happens when the THC in legally usable THC is converted to Delta 8. Unlike CBD, Delta 8 is reported to actually make people feel a degree of intoxication. It is not quite as intense as marijuana, but users do report a mild euphoria and a change in perception of reality. A variety of anecdotal reports exist about the effects of the substance, with users reporting this type of high. For example, one user reports feeling energized and able to conduct more work. Others have said it helps them feel less anxious and that it reduces pain and anxiety.
Delta 8 exists in an interesting legal space between marijuana and hemp. It is currently legal at the federal level – or at least it isn’t illegal. However, thus far, many states have banned Delta-8, with more following, arguing that it is essentially a drug. Furthermore, the United States Drug Enforcement Administration has proposed banning Delta 8, so how long the product is on the market may be in the air. However, for the moment, unless you live in a state in which Delta 8 has been banned, its purchase, use, and transportation are perfectly legal.
Like CBD products, Delta 8 is available in many forms. These include edibles like gummies, vape cartridges, tinctures, and smokable rocks.

Is Delta 8 Safe?

This question is difficult to completely answer based on available information. Furthermore, there are no studies that demonstrate the long-term impacts of Delta 8 THC, so it is impossible to determine the long-term safety of the product. However, in terms of immediate safety risks, users have reported using Delta 8 THC, safely enjoying the product, and not reporting any immediate after-effects.
It is worth noting that Delta 8 is sold in a very different regulatory scheme in the United States: There is no one supervising its manufacturing or sale, and no governmental authority that conducts regular testing or examinations of its product. This is very unlike the legal marijuana marketplace. As such, there is nothing to prevent unscrupulous vendors from selling you a bad or dangerous product, and this is something you should absolutely be concerned with. Some vendors will sell their products with a Certificate of Analysis, meaning that a third party has reviewed the content of their Delta 8 and made the lab results publicly available.

Other reports – including one by the Cannabis Council, a United States trade group – have explicitly noted this problem and the potential danger that Delta 8 may pose by not having any of the stringent regulations that marijuana manufacturers must adhere to. This problem has helped to explain why Delta 8 THC is currently banned in fifteen states, with six other states and the United States Drug Enforcement Agency seeking a similar ban.
Also unknown are the long-term effects of Delta 8 THC. There has literally only been one clinical trial on Delta 8 since 2008. As such, it is impossible to determine the safety and long-term impacts of the product.

How is Delta 8 Made?

Delta 8 THC is made by a conversion process. One of the things that make creating Delta 8 so easy is its chemical similarity to Delta 9 THC, more commonly known as the type of THC that is found in marijuana. Delta 9 THC has a double bond on its 9th carbon, while Delta 8 THC has that bond on its 8th carbon.
Delta 8 THC is usually made by starting with CBD. From there, the conversion process is relatively easy. This also explains why Delta 8 THC has become so popular over the past few years, as CBD was legalized in the 2018 Farm Bill. The passage of that bill also created a legal gray area in which Delta 8 THC exists.
A four-step process is usually used in order to convert CBD into Delta 8:

The CBD is dissolved using a solvent of some type.

An acid is then added to the remaining solvent, and the substance is mixed and stirred for an extended period of time. Different combinations of solvents and acids can be used to get different types of Delta 8.

The remaining product is rinsed with a specific solution, then dried.

Testing is then done on the product to ensure that it has been successfully converted – with as much purity as possible – into Delta 8.

This requires a degree of expertise and some equipment, but it can be done relatively easily and with minimal equipment by individuals who have the necessary expertise. However, as you can see, you should only use a Delta 8 product that has been created by reputable professionals. Selecting a product done on the cheap can result in you consuming any number of unhealthy products, potentially with dangerous results.

Will Delta 8 THC Get You High?

Yes. The chemical composition of Delta-8 THC will get you high, and this has been confirmed by countless users who have used the compound.
Delta-8 THC exists in an odd legal space and is often referred to as marijuana-light. It is a variant of cannabis and contains less than .3% THC, which is why it is legally sold in many states – for now. The manufacturing process for Delta-8 THC alters the CBD and limits THC in the compound. This results in the creation of Delta 8. Delta 8 THC is very similar to Delta 9 THC, which is the kind of THC you will find in marijuana. There are slight chemical differences, and these differences are responsible for the different effects of Delta-9 THC.
Users who have tried the compound reported a variety of experiences, including a euphoria-like feeling, a head rush, relaxation, increased focus, and more. Like any drug, everyone will have different experiences when using Delta-8, but based on the reports of others, the compound will result in a feeling of intoxication. This feeling will not be the same as using marijuana, but unlike using CBD, you will feel intoxicated.
These impacts are why fifteen states have banned Delta-8 THC so far, and another six are considering doing so. Furthermore, the United States Drug Enforcement Agency has proposed a ban on the substance, noting its similarity to marijuana, and noting that it creates some intoxication. That hasn’t happened yet, but it may in the future.

Where is Delta 8 Available?

This question may get confusing, depending on where you live. It is also subject to change.
In theory, Delta 8 should be available anywhere in the United States. As of yet, there are no nationwide regulations preventing its sale, which means that it could be available anywhere. However, the Drug Enforcement Agency is attempting to ban its sale, citing its similarity to marijuana, which remains illegal at the federal level. That ban has yet to take effect, but if it does, it would amount to a nationwide ban against the use, sale, transportation, and manufacturing of Delta 8.
However, fifteen states have banned the sale of Delta 8. Another six states are considering such a ban. This means that Delta 8 should not be available in these states and that purchasing or selling Delta 8 in these states would mean that you are running afoul of the law.
That being said, Delta 8 is still legal to sell and purchase in many places in the United States, and there are no nationwide restrictions – yet – on its sale. This means that you should be able to get Delta 8 anywhere, including in any commercial store, or on the internet. Indeed, a slew of websites sell Delta 8 in the United States and appear to be willing to ship them anywhere – including to states in which the product is banned. Keep in mind that buying Delta 8 in these states could potentially expose you to criminal liability.

Can I Get Delta-8 Mailed To Me?

Yes, Delta-8 is legal in the United States on the federal level, so you can feel safe placing an order online. The United States Postal Service even published a clarification of regulations in regards to hemp products (i.e. Delta 8-THC) stating they can safely and legally be shipped within the United States. Still, stores carrying Delta-8, as well as manufacturers, will prohibit a purchase if the shipping address is located in a state that prohibits Delta-8. If your state has deemed Delta-8 THC products legal, you can enjoy the benefits of online ordering which include convenience, the ability to review third-party analysis at sites such as realtestedcbd.com, and a cheaper price, as physical stores carry many hidden costs such as costly overhead. Ordering directly from a Delta-8 manufacturer also drastically increases the chances of receiving a fresher Delta-8 product.

Why is Delta-8 Controversial?

Delta-8 products have yet to be evaluated or FDA-approved for safe usage. There are concerns involving the various formulations of D-8 products as well as their labeling, cannabinoid/terpene content, and THC concentration. Some manufacturers even label D-8 products as “hemp products,” which can lead consumers to mistakenly consider them to be non-psychoactive.

Delta-8 THC being marketed for therapeutic and medical uses is another issue considering it has yet to be approved by the FDA. In fact, it is a violation of federal law, all while putting consumers of D-8 products at risk. The FDA has received reports of adverse events due to the consumption of Delta-8 THC-containing products, which included emergency room visits for symptoms such as vomiting, hallucinating, loss of balance, and even unconsciousness.

Additionally, the amount of Delta-8 THC found in hemp is naturally very low, leading to manufacturers resorting to synthetic conversion where unsafe household chemicals are used to convert cannabinoids such as CBD into Delta-8 THC.
