Earlier this month, Illinois hemp entrepreneurs came out in favor of a state legislative proposal which would regulate the hemp industry within the state. While many business owners can’t imagine asking for more regulation and taxation, this might actually be the best way to keep the state’s hemp industry afloat. 

The proposed legislation would implement a number of regulations on the state’s hemp industry, such as required testing and labeling of hemp products, limiting hemp sales to customers 21 and older, and prohibiting the sale of products which resemble well-known snack brands. This bill would also create an unlimited amount of $500 licenses, as well as 10% wholesale and 10% retail taxes. 

What Hemp Products are Legal in Illinois?

There is currently very little to no oversight of the hemp industry on a federal level. This is primarily because the FDA has not approved CBD for use in conventional foods or dietary supplements. Because of this lack of federal regulation, individual states have been left to their own devices when it comes to how they believe the hemp industry should be regulated.

Obviously, this has led to some inconsistencies when it comes to hemp and CBD legality across the states. For instance, some states maintain that the federal legal limit of 0.3% THC in hemp products is acceptable, while others don’t permit hemp products to contain any traceable amount of THC whatsoever.

Hemp CBD products are legal in the state of Illinois and there is currently no statewide law that requires customers to be of a certain age to purchase hemp-derived products. However, this could all change with new legislation.

This proposed regulation and taxation of the Illinois hemp industry is actually a response to another bill, supported by the Cannabis Business Association of Illinois, which would prohibit the sale of hemp products that are determined to be “intoxicating.” Many hemp business owners in the state are concerned that this bill would lead to a prohibition of hemp-derived products, and make it difficult to even sell CBD products. 

 Supporters from both sides of the issue recognize the need to keep intoxicating hemp products away from minors. The business owners calling for regulation and taxation are offering a solution which would allow CBD retailers to survive.
