A new study conducted by researchers at the National Institute of Standards and Technology (NIST) found that over 90% of smokable hemp strains they tested contained more than the legal amount of delta-9 THC. Because of these elevated delta-9 levels, these hemp strains are classified as “marijuana,” and are therefore federally illegal. Not only can an undisclosed amount of delta-9 THC produce unwanted side effects, most notably a psychoactive “high,” but it can also potentially land customers in hot water if they live in a state where marijuana is not legal. How Much THC Can Hemp Products Legally Contain?
According to the 2018 Farm Bill, hemp products may legally contain up to 0.3% delta-9 THC. While the Farm Bill is up for renewal later this year, that limit doesn’t seem likely to change. Cannabis products which contain more than 0.3% THC are federally prohibited as a Schedule 1 controlled substance.
Researchers at NIST tested 53 smokable hemp strains from five different manufacturers for this study. The manufacturers and products were not named, but they were all marketed and sold as legal hemp. About half of the samples were actually found to contain over a 50% difference in THC levels, compared to their label claims. The study states that possible causes for such a large discrepancy could be different testing methods, inconsistencies across product batches, or even, “product labels or online documentation that are not representative of actual products.” Regardless of the cause, the results of this study highlight the importance of third-party lab testing in the hemp industry.
