Preliminary approval has been granted by a Nebraska legislative committee for a bill that would tax CBD and hemp products at 100% in the state. This tax hike is a part of new legislation that has been designed to help offset property tax bills. Along with other reforms, such as the removal of sales tax exemptions for candy, soda, pet services, and lottery tickets, this change is estimated to bring in $182 million in new revenue for the state of Nebraska.
Some local politicians are praising the property tax relief plan while others are opposed to it, claiming that the proposal is the largest tax increase in Nebraska state history. Both recreational and medicinal marijuana use are still illegal in the state, but a new measure that may appear on ballots this November may change that. A recent poll showed that 70 percent of Nebraska residents are in favor of legalizing medical marijuana. Nebraska governor, Jim Pillen, however, is concerned that legalization “poses demonstrated harms to our children.” He maintains the belief that medical marijuana should first be approved by the FDA before it is made accessible to the public.
Stay Up to Date with Hemp Legality!
The legal landscape of the hemp industry is constantly evolving. This is especially true because there is minimal federal oversight on the hemp industry. This means that the legality of various hemp products may vary from state to state. For instance, while hemp products that contain 0.3 percent or less delta-9 THC are fully legal in California, delta-8 products have been deemed illegal in other states like Kentucky.
The 2018 Farm Bill was set to be reauthorized last year, but an extension was granted so that it will be renewed in September of this year. Some representatives are already pushing for changes to the Farm Bill before it is reauthorized. The most notable of these proposed changes is a crackdown on “intoxicating” hemp products, such as those which contain delta-8 THC. In fact, Nebraska’s attorney general, Mike Hilgers, filed suit against hemp retailers in the state for selling delta-8 products. This all goes to show that delta-8 products may not be as easily accessible in the future.
