CanX CBD, a CBD manufacturing company based in Iasi, Romania, was raided by local police forces last September. The company’s entire staff was arrested and all of their products were seized. Philipp Fuhrmann, the company’s CEO, asserts that they were paying their taxes and were registered through all the necessary channels to be considered legitimate. 

Can X has been selling products that contain HHC, a newly-identified cannabinoid, since 2022. Prior to that, they received confirmation from the Romanian Ministry of Health that HHC was legal. This is just one example of how the confusing legal landscape surrounding hemp, not only on a national level, but an international one, can be potentially treacherous for manufacturers. 

What is HHC?

While HHC is technically a member of the THC family, it isn’t a naturally occurring cannabinoid: it is created in a lab setting by pumping extra hydrogen atoms into a THC. The first American team to produce HHC used delta-9 THC as their starting material, but now most companies start with delta-8 THC or CBD, since delta-9 is federally illegal.

It appears that HHC products which don’t contain delta-9 may be a choice alternative for the psychoactive cannabinoid. Not only is it reported to produce a similar, sativa-like “high” effect as delta-10 THC, but, in some instances, it’s also gone undetected on drug screenings. Why Was CanX CBD Raided?

On September 19, 2023, Romanian armed special forces raided the CanX facility. Mr. Fuhrmann voluntarily went with officials to produce the necessary licenses and prior correspondences with the Romanian government, but he and his seven staff members were subsequently detained. This was just one of 100 raids carried out across Romania that day, as DIICOT and the Iasi Organised Crime Squad arrested 28 individuals and seized thousands of items. 

After being placed in a 24-hour detention, Fuhrmann and his staff were placed in front of a judge, who let them go after seeing their documented correspondence and registrations. However, a week later, they were put back into “preventative detention” for the next 54 days.

The two main allegations held against CanX are ‘the establishment of an organized criminal group’, and carrying products which are considered ‘likely to have psychoactive effects.’ It is important to note that the ANA in Romania publicly stated on March 17, 2023 that HHC was legal in Romania. CanX CBD has registered complaints against both the Romanian Ministry of Health and the ANA regarding the lack of governance. This instance only highlights the need for standardized hemp regulation, not only across the country, but across the world.
